express or implied, as to the results or experiences to be attained
from the purchase of our tickets or use of the products or services
we sell, and there are no express or implied warranties of merchantability
or fitness for a particular purpose or use. Much of the information
contained on New Year's Nation's websites was provided to us by
the entity or entities hosting New Year's Nation events and providing
other services, such as entertainment, at New Year's Nation events.
New Year's Nation does not guarantee the accuracy or completeness
of this information provided to us by third parties. New Year's
Nation shall not be responsible for or have any liability for any
injuries or damages caused by errors, inaccuracies, omissions or
any other failure with respect to the products and services described
herein, from whatever cause. To the extent permitted by law, it
is agreed that the liability of New Year's Nation hereunder for
damages, regardless of the form of the action, shall not exceed
the price paid by the ticket purchaser for the event that is the
subject of the complaint therein and that this shall be ticket purchaser's
exclusive remedy. New Year's Nation shall not be liable for any
default resulting from force majeure,
which shall be deemed to include any circumstances beyond the reasonable
control of the party or parties affected. No action, regardless
of form, arising out of or pertaining to the purchase of tickets
herein may be brought by the ticket purchaser more than one (1)
year after the cause of action has accrued. New Year's Nation shall
not be liable for any claim or demand against the ticket purchaser
by a third party.
In addition to the requirement that all ticket
purchasers be age 21 or over, each
event venue may have specific requirements for admission to the
event and/or premises, including, but not limited to, dress codes.
By purchasing a ticket, each ticket purchaser agrees to comply with
any and all requirements set forth by the event venue. The ticket
purchaser further agrees to hold New Year's Nation harmless from
any damages caused by a denial of entry or early dismissal for failure
to comply with the event venue's entry requirements or any other
reason.
